“لكل شخص الحق في أن يلجأ إلى المحاكم الوطنية المختصة لإنصافه من أعمال فيها اعتداء على الحقوق الأساسية التي يمنحها إياه القانون.”
ومع ذلك، يعاني العديد من الأفراد، خصوصا من الفئات الهشة والمهمشة، من عراقيل متعددة تحرمهم من هذا الحق.
الحق في العدالة أساس من أسس الكرامة الإنسانية
رغم وضوح النصوص الدولية التي تكفل الحق في التقاضي والعدالة، إلا أن هذا الحق لا يمارس بشكل عادل أو متاح للجميع. ففي كل يوم، هناك من يُحرم من المحاكمة العادلة أو التمثيل القانوني أو حتى الفهم القانوني لما يمر به من انتهاكات.
عوائق تحول دون تحقيق العدالة
العدالة لا تقاس بوجود القوانين فقط، بل بإمكانية الجميع في التمتع بها فعليا. ومن أبرز العوائق:
العبء المالي
رسوم التقاضي، أتعاب المحامين، وتكاليف الإجراءات القضائية تمثل عبئا كبيرا على ذوي الدخل المحدود.

تسريع الإجراءات وتبسيطها بما يضمن الإنصاف والشفافية
تبسيط اللغة القانونية وتيسير فهم القوانين لعامة الناس
تدريب القضاة والعاملين في السلك القضائي على مناهضة التمييز والفساد
تعزيز ثقة المواطنين عبر تنفيذ الأحكام ومحاسبة المسؤولين عن الانتهاكات

Ignorance of laws and legal processes makes people vulnerable to exploitation and discourages them from claiming their rights.
